1. Agreement

These Terms of Service govern your use of neogevitylife.com and any purchase you make from us. The site is operated by Neogevity Life ("we," "us," "our"). By using the site or placing an order, you agree to these terms. If you don't agree, please don't use the site.

2. Eligibility

You must be at least 18 years old to purchase from this site. By ordering, you confirm that you are 18 or older and that the payment method you're using is yours or that you're authorized to use it.

3. Products Are Dietary Supplements, Not Drugs

NEONOX is a dietary supplement. These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.

Nothing on this site is medical advice, and using this site does not create a physician-patient relationship with anyone associated with Neogevity Life, including its founder. Content in our Learn section and elsewhere on the site is general education only.

Talk to your own physician before using NEONOX or any supplement, particularly if you are pregnant or nursing, under 18, have a diagnosed medical condition, or take prescription medication. Nitric oxide precursors can interact with blood pressure medication, nitrates, and blood thinners. Stop use and seek medical attention if you have an adverse reaction.

4. Founder's Financial Interest

Neogevity Life is founded and owned by a licensed physician who has a direct financial interest in the sale of NEONOX. Any statement about the product made by our founder, on this site or on social media, is an endorsement by an owner of the company and should be weighed accordingly.

5. Orders, Pricing, and Availability

All orders are subject to acceptance and product availability. We may refuse or cancel any order, including after an order confirmation has been sent, for reasons including suspected fraud, pricing or description errors, or quantity limits. If we cancel an order you've already paid for, we'll issue a full refund.

Prices are in U.S. dollars and may change without notice. We work to keep product descriptions, images, and pricing accurate, but we don't warrant that all content is error-free.

6. Subscriptions

Subscription purchases are governed by our Subscription Terms, which are incorporated into these Terms by reference.

7. Returns

Returns and refunds are governed by our Refund Policy, which is incorporated into these Terms by reference.

8. Testimonials and Reviews

Any testimonials or reviews on this site reflect the individual experience of that person. Individual results vary, and testimonials are not a guarantee that you will experience the same outcome. We do not pay for reviews. Where a reviewer has received free product or compensation, that connection is disclosed alongside the review.

9. Intellectual Property

All content on this site, including text, graphics, logos, images, the NEONOX and Neogevity Life names and marks, and the compilation of that content, is our property or licensed to us and is protected by U.S. and international intellectual property law. You may not reproduce, distribute, or create derivative works from it without our written permission.

10. Acceptable Use

You agree not to use the site to violate any law, infringe anyone's rights, transmit malware, scrape or harvest data, attempt unauthorized access, or interfere with the site's operation.

11. Third-Party Links

The site may link to third-party websites or research sources. We don't control those sites and aren't responsible for their content, accuracy, or practices.

12. Disclaimer of Warranties

Except as expressly stated in these terms or required by law, the site and our products are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions don't allow exclusion of implied warranties, so this may not apply to you.

13. Limitation of Liability

To the maximum extent permitted by law, Neogevity Life and its officers, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from your use of the site or our products. Our total liability for any claim will not exceed the amount you paid us for the product giving rise to the claim. Nothing in these terms limits liability that cannot be limited under applicable law, including liability for personal injury caused by our negligence.

14. Indemnification

You agree to indemnify and hold Neogevity Life harmless from any claim or demand, including reasonable attorneys' fees, arising from your breach of these Terms or your violation of any law or third-party right.

15. Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Agreement to Arbitrate. You and Neogevity Life agree that any dispute, claim, or controversy arising out of or relating to these Terms, your purchase or use of any product, or your use of the site (a "Dispute") will be resolved by binding, individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies.

Class Action Waiver. You and Neogevity Life each agree that any arbitration or proceeding will be conducted only on an individual basis and not as a class, collective, consolidated, or representative action. The arbitrator has no authority to combine more than one person's claims or to preside over any form of a class or representative proceeding. If this class action waiver is found unenforceable as to a particular Dispute, then that Dispute (and only that Dispute) will be resolved in court, not in arbitration, and the remainder of this Section 15 stays in effect.

Arbitration Rules and Process. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The arbitration will be held in Dallas County, Texas, or another mutually agreed location, or may be conducted by phone, video, or written submission where permitted by the AAA rules. The arbitrator, not any court, has exclusive authority to resolve any dispute about the interpretation, applicability, enforceability, or formation of this arbitration agreement, except the Class Action Waiver may only be interpreted by a court.

Opt-Out Right. You may opt out of this arbitration agreement within 30 days of the date you first agree to these Terms by emailing support@neogevitylife.com with your name, order number or account email, and a clear statement that you wish to opt out of arbitration. If you opt out, neither you nor Neogevity Life is required to arbitrate Disputes with each other, and the Governing Law and Venue section below applies instead.

Costs. Neogevity Life will pay AAA filing fees for individual claims up to the amount required by the AAA Consumer Arbitration Rules and will not seek attorneys' fees or costs in arbitration unless the arbitrator finds your claim frivolous.

Survival. This Section 15 survives termination of your relationship with Neogevity Life and any resolution of a Dispute.

16. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. For any Dispute not subject to arbitration under Section 15, exclusive jurisdiction and venue lie in the state or federal courts located in Dallas County, Texas, and you consent to the jurisdiction of those courts.

17. Severability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce any right or provision is not a waiver of it.

18. Changes to These Terms

We may update these Terms at any time. The version posted on this page governs your use of the site. Material changes will be reflected in the "Last updated" date above. Continuing to use the site after a change means you accept the revised Terms.
